MAPNODE USER AGREEMENT

INTRODUCE

Welcome to the MapNode platform. By accessing or using the services provided by MapNode (“we,” “our,” or “MapNode”) through our website, application, or application programming interface (API), you agree to be bound by the terms set forth in this User Agreement (“Agreement”) and related policies, including but not limited to the Privacy Policy.

Please read this Agreement carefully before using MapNode. If you do not agree to any part of this document, you must immediately cease accessing or using the services.

1. TERMS OF SERVICE USE

The MapNode ecosystem, including: MapNode, MapScan, MapCEX, MapWallet, MapMarketCap provides a Web3 platform that integrates blockchain map data, with the goal of helping users explore digital assets, transactions and related data in a transparent and intuitive way. The MapNode ecosystem's services are only allowed to be used by individuals with full civil capacity and over the age of 18 according to the current laws in the country of residence. We do not provide services in restricted jurisdictions.

2. USER ACCOUNTS

To access full functionalities of MapNode, you must register a valid account. Upon registration, you commit to providing accurate, complete, and up-to-date information. You are responsible for safeguarding your login credentials and are fully liable for any activity conducted under your account, including unauthorized access unless timely notification is provided to MapNode.

We reserve the right to suspend or terminate your account if any violation of terms is detected, including but not limited to illegal use, fraudulent activities, or system abuse.

3. USER RIGHTS AND RESPONSIBILITIES

You agree to comply with all relevant laws when using MapNode. You are only allowed to use the platform within the scope of individuals and organizations; it is strictly forbidden to use the platform to engage in any illegal activities, including: money laundering, terrorist financing, financial fraud, malware distribution or dissemination of false information.

You may not access, use, or copy MapNode’s source code, content, or interface without our written consent. Any unauthorized copying, reuse, or distribution is strictly prohibited and may be prosecuted under applicable laws.

4. DIGITAL ASSETS AND TRANSACTIONS

MapNode does not provide custodial services or investment advice. All digital asset transactions through the platform are performed voluntarily and at your own risk. We do not guarantee the value, liquidity, or existence of any asset displayed on MapNode.

You acknowledge that digital assets are subject to high volatility and may lose all value. We encourage you to conduct thorough research before engaging in any investment activities.

5. INTELLECTUAL PROPERTY

All content displayed, source code, databases, icons, designs, algorithms, and technical materials on the MapNode platform are the intellectual property of MapNode or its licensed third parties. Users may not modify, republish, distribute, or create derivative works from any part of the platform without prior written approval.

6. DISCLAIMER OF LIABILITY

MapNode shall not be held liable for any losses, damages, or harms arising from the use or inability to use our services, including but not limited to system errors, cyberattacks, software failures, or third-party fraud. All services are provided "as is" without any warranties, express or implied.

7. PRIVACY POLICY

All personal information collected from users is processed in accordance with MapNode’s official Privacy Policy. By using our services, you acknowledge that you have read, understood, and agreed to that policy.

8. AMENDMENTS TO THE AGREEMENT

We reserve the right to update, modify, or amend this Agreement at any time. Revisions shall become effective immediately upon being published on the platform. Your continued use of the services after such changes indicates your acceptance of the updated terms.

9. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement, and any dispute, controversy, or claim arising out of or relating to this Agreement, your use of the MapNode Services, or any transaction conducted through the platform, shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any such dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration proceedings shall be conducted in English and held in Wilmington, Delaware, unless the parties mutually agree otherwise in writing. The decision of the arbitrator shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

By agreeing to this Agreement, you acknowledge and expressly waive your right to participate in any class action lawsuit or class-wide arbitration against MapNode. You agree that any claims or disputes will be resolved on an individual basis through arbitration, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

MapNode (referred to as "the Company", "MapNode", "we", "our") is committed to protecting your personal data and prioritizes your privacy as a top concern.

  • (a) when using our products and services;
  • (b) when creating an account with us;
  • (c) through other agreements or contractual arrangements.

  • (b) when you visit our website;
  • (c) when you contact us directly or we contact you;
  • (d) when we contact you directly;
  • (e) when we collect information about you from third parties; and other channels including our helpdesk.
3. HOW DO WE COLLECT YOUR PERSONAL DATA ON OUR WEBSITE?
  • (a) IP Address: Used for diagnosing server issues and managing the site.
  • (b) Cookies: It is important that you prevent unauthorized access to your password and computer. You should always log out after using a shared computer. The information collected from cookies is used by us to evaluate the effectiveness of our website, analyze trends, and administer the platform. The information collected from cookies allows us to determine things like which parts of our website are most popular and what difficulties visitors may have when using our website. With this knowledge, we can improve the quality of your experience on our platform by recognizing and providing more of the features and information you want, as well as addressing accessibility challenges. We also use cookies and/or a technology called web bugs or clear gifs, which are typically stored in emails, to help us confirm that you have received and responded to our emails, and to provide you with a more personalized experience when using our website. Your continued use of this website, as well as any subsequent use, will be deemed to be your consent to the storage of cookies on your device.
  • (c) User Feedback Forms: Our feedback form asks you to provide us with contact information (e.g. your name and email address) so that we can respond to your comments.   • (d) General Website Tracking: We also use third-party service providers to help us better understand the use of our website. Our service providers will place cookies on your computer's hard drive and will receive information that we choose, such as how visitors navigate around our website, which pages are viewed, and general transaction information. Our service providers analyze this information and provide us with aggregated reports. The information and analysis provided by our service providers will be used to help us better understand the interests of visitors to our website and how to better serve those interests. The information collected by our service providers may be linked and combined with the information we collect about you while you are using the platform. Our service providers are contractually restricted from using information they receive from our Site other than to assist us.
  • (e) Web Server Access Logs:

    Here is how we store our web server website access logs:

    • (i) In order to throttle request rates and prevent certain types of attacks against us, we track incoming IP addresses for a very short period of time and then release them.
    • (ii) By default, we do NOT store identifiable 'x-forwarded-for' originating IPs during your visit to the website in our web server website access logs.
    • (iii) However, in the event of certain types of third-party attacks, general server/application troubleshooting, or other related reasons, we may temporarily enable 'x-forwarded-for' logs.
    • (iv) As part of our regular server maintenance, all raw web server website access logs are only retained for a minimum of 5 days and are then deleted on an automated schedule.
4. WHAT DO WE USE YOUR PERSONAL DATA FOR?

We may use your Personal Data for the following purposes:

  • (a) To enable us to provide our services and perform services to you;
  • (b) To protect the safety and health of you and/or other customers;
  • (c) To investigate and respond to complaints and queries from you;
  • (d) For business development purposes such as statistical and marketing analysis, system testing, maintenance and development, customer surveys or to assist us in any future dealings with you, for example by identifying your requirements and preferences;
  • (e) To comply with any legal or regulatory requirements; and/or
  • (f) For all other purposes in addition to any of the purposes set out above. ("Core Purposes")
  • (g) To communicate offers, products, services and information about products and activities;
  • (h) Marketing/cross-marketing and communicating with you in relation to products and services offered by us and our service partners and our appointed agents; and/or
  • (h) For all other purposes ancillary to any of the purposes set out above. ("Ancillary Purposes") (collectively, the "Purposes")
5. ACCESS / UPDATE / MODIFY YOUR PERSONAL DATA

You may request information about your personal data as well as update or correct your personal data as follows: (a) For customers who have registered online, you may log in to your online account and update your personal data.

Please note that depending on the information requested, a nominal fee may be charged and/or supported by a BNB Smart Chain signed message. We will endeavour to provide you with the information as soon as possible. However, we also reserve the right to verify all requests for authenticity.

6. WITHDRAWING CONSENT

Please note that the Company is obliged to process your Personal Data for the Core Purposes as set out above, otherwise certain services or features provided by MapNode may be affected.

If we do not have your consent to process your Personal Data for the Ancillary Purposes, we will not be able to update you about our future, new and/or improved services and products. However, you may stop receiving promotional activities by:

  • (a) Unsubscribing from mailing lists.
  • (b) Editing the relevant account settings to unsubscribe; or
  • (c) Sending a request via email to [email protected].
7. WHO DO WE DISCLOSE YOUR PERSONAL DATA TO?

We will not trade or sell your Personal Data to third parties. Your Personal Data will only be disclosed or transferred to the following third parties appointed or authorised by the Company to fulfil the Purposes: (a) data warehouses; (b) IT service providers; (c) data analytics and/or marketing agencies; (d) legal authorities as permitted or required by law such as to comply with a warrant or subpoena issued by a court of competent jurisdiction; and/or (e) regulatory authorities applicable to you; and/or (f) safety and security officers. In addition to the above, your Personal Data may also be disclosed or transferred to any actual or potential assignee, transferee or acquirer of the Company (including our affiliates and subsidiaries) or our business, assets or group companies, or in connection with any corporate restructuring or undertaking including our restructuring to transfer business, assets and/or liabilities.

We will take reasonable steps to ensure that our employees, officers, agents, advisers, contractors and other third parties referred to above who are involved in the collection, use and disclosure of your Personal Data will comply with the terms of this Privacy Statement.

We are subject to various legal and regulatory obligations imposed by the laws and supervisory authorities of various jurisdictions, such as anti-money laundering, counter-terrorist financing, financial services, company and privacy laws. These obligations may require us to process certain data for payment processing, compliance with court orders or other purposes not disclosed here.

8. HOW LONG WILL WE STORE YOUR PERSONAL DATA?

The Company stores data with a global hosting provider with servers in multiple regions and we will take all reasonable steps to ensure that any Personal Data is destroyed or permanently deleted when no longer required for the Purposes and schedule the data to be inactive after 24 months.

9. LINKS TO THIRD-PARTY WEBSITES

We may link this website and/or our applications to websites of other companies or organizations (collectively, “Third-Party Websites”). This Privacy Notice does not apply to third-party websites because such websites are beyond our control. If you access third-party websites using the links provided, the operators of these websites may collect personal information about you.

Please ensure that you are comfortable with the privacy statements of these Third-Party Websites before you submit any personal information. We make every effort to ensure that all third-party linked websites have equivalent measures in place to protect your personal information, but we cannot be responsible, legally or otherwise, for the practices, privacy policies, or privacy compliance of these Third-Party Websites.
